# Terms of Service

> The rules governing your use of MinkMap. By using MinkMap, you agree to these terms.

MinkMap is a tool built for software developers and QA engineers — not for gaming, social manipulation, or general consumer use. Before you use MinkMap, read these terms carefully. They define what you're allowed to do, what we're responsible for, and what happens if things go wrong.

  <Accordion title="Who can use MinkMap">
    You must be at least 18 years old, or the age of majority in your jurisdiction, to use MinkMap. By creating an account, you confirm that you meet this requirement.

    MinkMap is intended exclusively for:

    * Software developers testing GPS behavior in their applications
    * QA engineers verifying location-based features
    * Privacy researchers examining how apps handle location data

    MinkMap is **not** a general consumer product. It is not designed for, and must not be used for, gaming, social manipulation, personal advantage, or any purpose outside legitimate development and testing workflows.

  <Accordion title="Permitted uses">
    You may use MinkMap to:

    * Test and debug GPS functionality in apps you are developing or testing
    * Simulate device locations as part of a QA or development workflow
    * Research how applications respond to location inputs for privacy or security purposes
    * Demonstrate location-based features in development or staging environments

  <Accordion title="Prohibited uses">
    You must not use MinkMap to:

    * Violate any applicable law or regulation
    * Breach the Terms of Service of Apple, Google, or any other third-party platform
    * Cheat, defraud, or harass any individual or organization
    * Gain personal advantage in location-based games (e.g., spoofing in Pokémon GO or similar apps)
    * Manipulate dating apps, social platforms, or any service that relies on authentic location data
    * Obtain financial gain through deception or misrepresentation of your location
    * Reverse-engineer, decompile, or otherwise attempt to extract the source code of MinkMap's software
    * Bypass geofencing, access controls, or geographic restrictions on any platform or service
    * Distribute malware or use MinkMap as part of any malicious software campaign

    Violations may result in immediate account suspension and legal action. See the [Acceptable Use](/legal/acceptable-use) page for more detail.

  <Accordion title="Your account">
    When you create an account, you agree to:

    * Provide accurate and complete information
    * Keep your login credentials secure and confidential
    * Notify us immediately at [contactus@minkmap.com](mailto:contactus@minkmap.com) if you become aware of any unauthorized access to your account

    You are responsible for all activity that occurs under your account. We are not liable for losses caused by unauthorized access to your account if you failed to take reasonable precautions.

  <Accordion title="No warranties — use at your own risk">
    MinkMap is provided **"AS IS"** without any warranty of any kind, express or implied. We do not warrant that:

    * The service will be uninterrupted, error-free, or meet your requirements
    * Results obtained through MinkMap will be accurate or reliable
    * Any defects will be corrected

    Your use of MinkMap is entirely at your own risk.

  <Accordion title="Platform risk">
    Using MinkMap may violate the Terms of Service of Apple, Google, or other third-party platforms. This is your responsibility to assess before using the service.

    MinkMap Inc. is not affiliated with Apple, Google, or any other platform. We accept no liability for account bans, app rejections, device restrictions, or any other consequences arising from your use of MinkMap in connection with third-party platforms or services.

  <Accordion title="Limitation of liability">
    To the maximum extent permitted by applicable law, MinkMap Inc.'s total liability to you for any claim arising from or related to these terms or your use of the service is limited to the lesser of:

    * The total amount you paid to MinkMap Inc. in the 12 months preceding the claim, or
    * **\$100 CAD**

    We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

  <Accordion title="Governing law and disputes">
    These terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

    Any dispute arising from or relating to these terms or your use of MinkMap that cannot be resolved informally will be settled by binding arbitration administered by the **Canadian Arbitration Association** in accordance with its rules. Arbitration will take place in Ontario, Canada. You waive any right to participate in a class action lawsuit or class-wide arbitration.

  <Accordion title="Changes to these terms">
    We may update these terms from time to time. When we do, we will update the version number and effective date at the top of this page. Continued use of MinkMap after changes take effect constitutes your acceptance of the revised terms.

    If changes are material, we will make reasonable efforts to notify you — for example, by email or by displaying a notice in the app.
